The order handed over at the hearing is not the same as a certified copy issued under the court seal, and only the latter will get through the SDM. Get the certified copy from the court that granted the decree before anything else — it is the step that actually takes time.

The MEA verifies the SDM signature against its records and affixes the apostille sticker with its QR code. The MEA accepts no document directly from an individual, so we deposit through an MEA-authorised collection channel.

Does a Divorce Decree need notarisation first?

No. A divorce decree issued by The Family Court or District Court that granted the decree is a public document, so the SDM attests it directly and no Notary Public is involved. Notarisation applies to privately-made documents — affidavits, powers of attorney, employer letters and certified copies — where there is no government signature for the SDM to verify. If an agency tells you your divorce decree must be notarised first, ask them why.

SDM or State Home Department?

Personal documents can be pre-authenticated by either the SDM or the State Home Department. We default to the SDM because it is materially faster, and because the slower route rarely buys the customer anything. The exception matters though: some destination countries and some receiving institutions specifically require Home Department attestation, and getting that wrong means running the whole process again.

The SDM is a district-level officer, so the office that pre-authenticates your divorce decree follows the district where it was issued — not where you live now. The Home Department alternative is state-level. Both routes end at the same MEA counter, and our price is the same from every state.

What about e-Sanad?

Court records are generally not onboarded to e-Sanad. Assume the physical apostille route and check esanad.nic.in only if the receiving authority specifically raises it.

e-Sanad is the government's own free platform for digitally verifying documents from onboarded issuing authorities. Where it covers your document and your destination accepts it, it is genuinely the better option and we will tell you so. It is not a replacement for a physical apostille sticker in most cases.

Why People Apostille a Divorce Decree

Remarriage abroad

Foreign civil registries require proof that a previous marriage was legally dissolved before they will register a new one, usually alongside a single-status affidavit.

Spouse and dependent visa filings

Where a current marriage followed a previous one, immigration authorities want the authenticated dissolution on file.

Name reversion

Reverting to a former name on a foreign passport, bank account or employment record generally requires the apostilled decree.

Property and custody matters

Foreign courts and registries acting on an Indian decree need it authenticated before they will give it effect.

Which Divorce Decree Do You Actually Have?

This is where applications fail, and it is almost never the apostille itself. Find your case below before you courier anything — a rejected document costs a full second run, not a correction.

Certified copy versus working copyOften rejected

Only a copy issued under the court seal, signed by the authorised officer, can be attested. The photocopy handed over on the day cannot. Request the certified copy from the court registry first.

Ex-parte decreeOften rejected

A decree granted in the absence of one party is a valid court order and can be apostilled. Some foreign registries scrutinise it more closely and may ask for the accompanying service record, so ask what they need before ordering.

Mutual consent divorce

Granted under section 13B of the Hindu Marriage Act or the equivalent provision. The most straightforward case — the certified copy routes through the SDM without difficulty.

Decree in a regional language

Common outside the metros. Apostillable as-is, but the destination will almost certainly require a certified translation alongside it.

What copy of a divorce decree can be apostilled in India?

Can an ex-parte divorce decree be apostilled?

Yes. An ex-parte decree is a valid court order and the SDM and MEA will process it. Be aware that some foreign civil registries examine ex-parte decrees more closely, particularly for remarriage, and may ask for the service record as well — check with them before you file.

Does a divorce decree need notarisation before apostille?
