The New York Quirk Worth Knowing

New York is really two states for this purpose. A certificate from the NY State Department of Health (a birth anywhere outside the five boroughs) usually goes straight to Albany and comes back the same day. An NYC-issued certificate needs a long-form vault copy with a Letter of Exemplification from DOHMH, and is then authenticated by the County Clerk — for example the New York County Clerk at 60 Centre Street in Manhattan — before the Department of State will apostille it. Budget extra weeks for a New York City birth.

New York City births are the most misrouted certificates in the whole OCI workload. Families see "same-day at the counter" for New York, plan around it, and then discover the exemplification and county-clerk steps sitting in front of that counter. If your child was born in Queens, Brooklyn, Manhattan, the Bronx or Staten Island, this applies to you.

We submit to New York Department of State, Division of Licensing Services by tracked mail, with India named as the destination country and the physical paper apostille explicitly requested rather than an e-apostille. Add a mailing leg each way to the office turnaround above when you plan your dates.

What is a Letter of Exemplification and do we need one?
It is a certification issued by NYC DOHMH confirming the birth record is a true copy from the city's vault. NYC-issued birth certificates need it — and usually a County Clerk authentication after it — before the New York Department of State will attach an apostille. Births outside the five boroughs, handled by the state office in Albany, generally do not.
Our child was born in Queens. How much longer does that take?
Materially longer than upstate. You are adding the DOHMH exemplification and a County Clerk step ahead of the Albany apostille, each with its own queue. Treat a New York City birth as a multi-week chain and start it well before booking the VFS appointment.
Our child was born in Buffalo, not NYC. Is it simpler?
Yes. A certificate issued by the New York State Department of Health goes directly to the Department of State for the apostille, at $10 per document, same-day at the counter. The exemplification and county-clerk requirements are specific to NYC-issued records.
