US Divorce Decree
Apostille for Use in India

Remarrying in India, updating your marital status, or settling property after a US divorce — Indian authorities will ask for the divorce decree, and they'll want it apostilled. Divorce decrees are court documents, which makes their chain slightly different: the certified copy comes from the court clerk, and the apostille from that state's Secretary of State. We handle the whole sequence.

The Correct Route

Who Actually Apostilles a US Divorce Decree

Competent Authority

Court clerk + state's Secretary of State

The decree must first be a certified (in some states, exemplified or "triple-seal") copy issued by the clerk of the court that granted the divorce. That certified copy is then apostilled by the same state's Secretary of State. Requirements vary by state and sometimes by county court — we verify the exact chain for your court before quoting.

Requirements

What You Need Before We Start

1

A certified copy of the final divorce decree from the court clerk — a plain photocopy or your attorney's copy cannot be apostilled.

2

Some states/destinations need the exemplified (judge + clerk certified) version — we confirm which one your use case requires.

3

The full decree including the final judgment page with the judge's signature and filing stamp.

When It's Needed

Where an Apostilled US Divorce Decree Is Required

Remarriage in India

Marriage registrars in India require proof that a prior US marriage legally ended — an apostilled divorce decree is the standard evidence.

Passport & records updates

Updating marital status or reverting names in Indian passports and government records needs the authenticated decree.

Property, alimony & succession

Indian courts and sub-registrars handling settlements connected to a US divorce ask for the apostilled decree before acting on it.

FAQ

US Divorce Decree Apostille — Common Questions

I only have my lawyer's copy of the decree. Can you apostille it?
Not directly — states apostille certified copies issued by the court clerk, not attorney copies. Most court clerks accept mail or online requests for certified copies; we'll point you to your court's process, or handle the request where the court allows third parties, then run the apostille.
What's an exemplified copy and do I need one?
An exemplified (or "triple-seal") copy carries certifications from the clerk and the judge — the highest form of court certification. Some states' Secretaries of State and some Indian authorities insist on it for foreign use. We check both your court's and your destination's requirements and tell you before anything is ordered.
Does a divorce decree go to the US Department of State for apostille?
No — state court decrees are apostilled by that state's Secretary of State. Only federal documents (FBI PCC, naturalization certificates, federal court documents) route through Washington, DC.
The divorce was decades ago. Is that a problem?
Usually not — courts issue fresh certified copies of old decrees routinely. Older or archived cases can take the clerk longer to retrieve, which we factor into the timeline we quote.
Can you handle my FBI PCC and divorce decree together?
Yes — they take different routes (DC vs. the state), but we process them in parallel from one shipment and return everything together. One combined quote, one tracked return package.
